The Customer is therefore prohibited from purchasing the Products with a view to reselling them or for any other professional use.<\/p><p>Any order placed by the Customer automatically implies, without restriction or reservation, his\/her irrevocable acceptance of the GTC. Thus, only the provisions of these GTC are binding between 31 Degr\u00e9s Boutique and the Customer, to the exclusion of all others.<\/p><p>31 Degr\u00e9s Boutique reserves the right to modify its GTC at any time, without prior notice. There are no spare parts for our products.<\/span><\/p><p><strong>3.2 AVAILABILITY<\/strong><\/p><p>Products are available for purchase while stocks last.<br \/><span style=\"font-style: inherit; font-weight: inherit; color: var(--ast-global-color-3);\">Stock is real (NO DROPSHIPPING) and is updated automatically.<br \/><\/span><span style=\"font-style: inherit; font-weight: inherit; color: var(--ast-global-color-3);\">When a Customer places an order on the Website, they are informed of the availability of the Products they wish to order.<\/span><\/p><p>Nevertheless, in the case of a Product ordered by the Customer eventually being out of stock, 31 Degr\u00e9s Boutique will inform the Customer by email as soon as possible. Therefore :<\/p><ul><li>if all the Products in the order are unavailable, the order will then be automatically cancelled and the Customer's bank account will be credited at the latest within 14 (fourteen) days following validation of the order,<\/li><li>if some of the Products in the order are unavailable, the Customer may then choose to replace the missing Product, maintain the order or cancel all or part of the order.<\/li><\/ul><p><strong>3.3 STOCK STATUS<\/strong><\/p><p class=\"p1\">There are 3 different categories that determine the availability of the item you want to purchase.<\/p><p class=\"p1\"><strong>\u2022 IN STOCK :<\/strong><\/p><p class=\"p1\">Si l&#8217;article est en stock, il vous est possible de cliquer sur le bouton pr\u00e9vu pour le commander. It is not 31 Degr\u00e9s Boutique's intention to sell to the Customer the Products offered in quantities exceeding the usual quantities intended to satisfy the Customer's private needs. We also guarantee that our products comply with all laws in force at the time of your order.<\/p><p>In addition, when it comes to the delivery goods, you benefit from the minimum legal guarantee period of two years in the event of non-conformity of the consumer goods, i.e. when the goods delivered do not correspond to those requested or ordered. This means that in the case of defects in goods that are discovered up to 2 years after delivery, the goods will be repaired, if not replaced.\u00a0<\/p><p>You have the right to repair or replace the goods free of charge (at the consumer's option, but subject to what is possible and reasonable). Only in the case where the repair or replacement requires disproportionate or impossible efforts or resources, or cannot be carried out within a reasonable time, then you have the right to demand a price reduction or reimbursement of the product.<\/p><p>If the defect is minor, you cannot demand a refund.<\/p><p>If the defect is detected within the first six months, it is presumed to have existed since delivery. The seller must prove the opposite if he disagrees. If the defect is discovered more than six months after delivery, the consumer must prove that the non-conformity existed at the time of delivery.<\/p><p><strong>4.2 COMMERCIAL WARRANTY<\/strong><\/p><p>All our watches come with a 2-year guarantee. Generally speaking, the guarantee covers manufacturing defects that occur during normal use of the product. This excludes<\/p><ul><li>replacement of consumables (batteries, wristbands, etc.)<\/li><li>damage resulting from unusual or improper use of the products. In this respect, we invite you to carefully consult the instructions for use included with the product (watertightness level),<\/li><li>damage caused by the use of an unauthorised repairer.<\/li><\/ul><p>Please note that the duration of the manufacturer's warranty may vary depending on the brand. The extent of a product's guarantee is detailed in the guarantee certificate accompanying each product.<\/p><p>A commercial guarantee is any contractual commitment by a professional to the consumer to reimburse the purchase price, replace or repair the goods, in addition to his legal obligations to guarantee the conformity of the goods.<\/p><p><strong>4.3 \u00a0CONDITIONS D&#8217;APPLICATION<\/strong><\/p><p>All watches sold by 31 Degr\u00e9s Boutique come with a two-year commercial warranty from the date of purchase, provided directly by 31 Degr\u00e9s Boutique as the seller. We work exclusively with certified suppliers and retailers who source their products from official manufacturers.<br data-start=\"625\" data-end=\"628\" \/>It is important to note that for certain brands such as Tissot or Seiko, the applicable warranty is not the manufacturer's warranty but the commercial warranty provided by 31 Degr\u00e9s Boutique. The new prices are applicable to orders placed from the date they are put online on the www.31degres.be website.<\/p><p>The price of Products offered for sale on the Website is indicated in Euros, inclusive of tax.<br \/>Prices do not include delivery charges. Delivery costs are fixed. The amount of the delivery charge is indicated to the Customer before the order is validated.<\/p><p><b>\u00a0MEANS OF PAYMENT<\/b><\/p><p>Payment of the order (price and delivery charges) may only be made by the following methods of payment:  BANK CARDS, Bancontact (Belgium), VISA, MASTERCARD, MAESTRO, IDEAL, APPLEPAY and PAYPAL.<\/p><p>The Customer's bank account is debited when the order is validated.<\/p><p><b>5.2 SECURITY OF PAYMENTS<\/b><\/p><p>The website www.31degres.be has an SSL security system.<br \/>The website www.31degres.be uses the secure payment solution provided by Mollie, a leader in the payment market.<\/p><p>To ensure secure online payment and guarantee the security of your personal data, transaction data is encrypted using SSL technology and transmitted over the Internet.\u00a0<\/p><p>As part of its policy of verifying orders and the quality of payments, 31 Degr\u00e9s Boutique may ask the Customer for a copy of an identity document as well as proof of address. font-style: inherit; font-weight: inherit;\">The Products are delivered to the address indicated by the Customer at the time of each order. If the Customer wishes to have the Products delivered to different addresses, separate orders must be placed.<\/span><\/p><p>31 Degr\u00e9s Boutique sends each Customer an e-mail notifying them that their order has been dispatched.<\/p><p><strong>7.2 DELIVERY TIMES<\/strong><\/p><p>Delivery times are generally 24 to 72 working hours in Belgium and 2 to 5 working days for French and Dutch customers. If no delivery time is indicated, the delivery time for the product may not exceed thirty (30) days after confirmation of the order.<br \/><span style=\"font-style: inherit; font-weight: inherit; color: var(--ast-global-color-3);\">An e-mail will inform the Customer of any delay in delivery.<\/span><\/p><p><strong>7.3    DELIVERY TRACKING<\/strong><\/p><p>Each Customer can follow the status of the processing of their order by 31 Degr\u00e9s Boutique via the tracking number they have received.<span style=\"font-style: inherit; font-weight: inherit; color: var(--ast-global-color-3);\">\u00a0<\/span><\/p><p><strong>7.4 DELAY IN DELIVERY<\/strong><\/p><p>If the average delivery time indicated is not respected, the Client may cancel the contract, by registered letter with acknowledgement of receipt or by a written document on another durable medium, if, after having enjoined 31 Degr\u00e9s Boutique, in the same manner, to carry out the delivery within a reasonable additional time, the latter has not done so within this time. The contract is considered to have been terminated on receipt by 31 Degr\u00e9s Boutique of the letter or written document informing it of this termination, unless the professional has performed in the meantime. The Client will then be reimbursed under the conditions set out in the paragraph \u2018Reimbursement of Products\u2019 in the Article \u2018RIGHT OF WITHDRAWAL\u2019.<\/p><p>If the average delivery time indicated to the Customer is not respected and if it appears that this delivery time constitutes an essential condition of the contract for the Customer, the Customer may immediately cancel the contract. This essential condition results from the circumstances surrounding the conclusion of the contract or from an express request made by the Customer before the conclusion of the contract. In this case, the contract will be considered to have been terminated upon receipt by 31 Degr\u00e9s Boutique of the letter or writing informing it of this termination. In the event of termination due to late delivery of the product(s), 31 Degr\u00e9s Boutique undertakes to reimburse the Customer for all sums paid, at the latest within fourteen (14) days following the date on which the Customer terminated the contract.<\/p><p>In the case of unforeseen circumstances (e.g. adverse weather conditions), we may not be able to deliver the goods by the agreed deadline. If the delay is due wholly or partly to the above circumstances, we cannot be held responsible for the delay or non-delivery of the goods. In the event of non-delivery, we will agree an alternative delivery date with you. We are not responsible for late delivery due to the unavailability of an individual to receive the goods. It is your responsibility to contact the post office or carrier to enquire about goods that could not be delivered due to your unavailability.<\/p><p><strong>7.5 NON-RECEIPT OF PACKAGES<\/strong><\/p><p>If, at the time of delivery to the address indicated by the Customer, the latter is not present or refuses the parcel, the parcel will be deposited at the \u2018parcel shop\u2019 closest to the Customer's home, where the Customer will be able to collect it during a period determined by the transport company, on presentation of the delivery notice deposited by the transporter in the Customer's letterbox.<\/p><p>At the end of this period, the carrier returns any unclaimed package to 31 Degr\u00e9s Boutique.<\/p><p>If a parcel is returned to 31 Degr\u00e9s Boutique for a reason attributable to the Customer, such as an \u2018unclaimed\u2019 parcel or \u2018does not live at the address indicated\u2019, 31 Degr\u00e9s Boutique will inform the Customer concerned by e-mail.<\/p><p>In this case, with the Customer's agreement, the parcel will be resent, the costs of resending being borne by the Customer. An e-mail will inform the Customer of the procedure to follow for payment of these delivery costs.<\/p><p>In all other cases, the parcel will be kept by 31 Degr\u00e9s Boutique for sixty (60) days. At the end of this period, 31 Degr\u00e9s Boutique may decide to keep the Products thus returned, without notice or formal notice. This does not give the Customer any right to reimbursement, replacement or compensation. The Customer will not be reimbursed for either the price of the order or the delivery costs.<\/p><p><strong>7.6 DAMAGED PRODUCT ON DELIVERY<\/strong><\/p><p>In the case where the Products are delivered damaged, the Customer must imperatively notify this fact to the transport company and to 31 Degr\u00e9s Boutique by registered letter with acknowledgement of receipt within forty-eight (48) hours (working hours) following delivery of the parcel.<\/p><p>This complaint must be justified and describe in particular the state in which the Products and their packaging were delivered to the Customer.<\/p><p>It is recommended that the package be examined in the presence of the delivery person and that any reservations be noted on the delivery note, a copy of which should be retained by the Customer.<\/p><p>Within this same period of forty-eight (48) hours, the Customer must send a duplicate of its complaint to the Customer Service of the Internet Site www.31 degres.be, by e-mail or by registered letter with acknowledgement of receipt, to the addresses shown in the Article \u2018Customer Service and complaints\u2019 of the GTC.<\/p><p>31 Degr\u00e9s Boutique will then contact the Customer by email in order to organise the return of the Products at 31 Degr\u00e9s Boutique's expense. Failing this, the right of withdrawal shall have no effect and the sale shall be final.<\/p><p>The Products must be returned intact, clean and complete (i.e. in perfect condition for resale, unmodified and in their original packaging), accompanied by any instructions and accessories.<\/p><p>The Customer must return the Products, clearly indicating the invoice number or the returns number allocated to them on the parcel. The Customer must also include a copy of the invoice in the parcel.<\/p><p>It is the responsibility of the Customer exercising his\/her right of withdrawal to reserve proof of the return of the goods by him\/her (presentation of a recorded delivery receipt, presentation of a document provided by the carrier, etc.).<\/p><p>Before refunding, 31 Degr\u00e9s Boutique reserves the right to carry out the necessary checks in the event of a discrepancy between the Products returned and the invoice enclosed or the returns number.<\/p><p><strong>8.2 REFUNDS<\/strong><\/p><p>The Customer will be reimbursed for an amount equal to the price of the Products returned plus the delivery costs paid by the Customer in respect of the denounced order, with the exception of additional delivery costs if the Customer has expressly chosen a more expensive delivery method than the standard delivery method offered by 31 Degr\u00e9s Boutique.
